Prompt dispatch and administrative silence: tools against State inaction

When the administration fails to rule within the statutory deadlines, the private party is not left without recourse: Law 19.549 provides instruments to break administrative inertia. The prompt dispatch request (pronto despacho) is the formal demand addressed to the authority requiring it to issue a decision. Administrative silence, once properly established, is equivalent to a denial (as the general rule) and opens the door to administrative or judicial challenge.

These mechanisms are central to immigration proceedings (DNM, citizenship, residency), tax matters (refunds, regularisation plans), social security cases (retirement pensions, disability benefits), and regulatory procedures (licences, registrations). Without a prompt dispatch request, a file can remain pending indefinitely; with one on record, deadlines become enforceable and the foundation for the next legal step is secured.

Negative administrative silence (general rule)

Article 10 of the Administrative Procedures Act provides that silence shall be construed as a denial unless an express provision states otherwise. For silence to be formally established: once the decision deadline has expired (sixty days as a general rule), a prompt dispatch request must be filed; if a further thirty days pass without a response, a constructive denial is deemed to have occurred and administrative or judicial proceedings may be commenced.

Accurate calculation of deadlines and thorough documentation of each prompt dispatch request are critical: a procedural misstep can foreclose all subsequent remedies. Positive administrative silence (exceptional)

Certain specific statutes provide for positive administrative silence: if the authority fails to issue a decision within the prescribed period, the requested authorisation or right is deemed granted. This is an exceptional mechanism and must be expressly established by law. Examples can be found in specific regulatory regimes, building permit procedures in certain municipalities, and select foreign trade transactions.

Prompt dispatch request as a procedural tool

The prompt dispatch request is the formal demand requiring the authority to issue a ruling. Filing it: (a) interrupts the procedural inactivity of the file and typically prompts a concrete response; (b) when no response is forthcoming, establishes the conditions required for administrative silence to be recognised; (c) demonstrates the party's diligence before any court that may later review the matter.

A common strategy involves filing two successive prompt dispatch requests, separated by a reasonable interval, before formal administrative silence is established. Proof of filing, precise identification of the case number, and an express demand for a decision are all mandatory formal requirements.
